The primary areas of AI law and litigation currently revolve around the fundamental challenges AI poses to human-centric Intellectual Property frameworks, encompassing Copyright, Patent, and Trade Secrets. Litigation topics are broadly categorized by the source of the conflict: AI standalone systems causing harm, the complex legal issues arising from AI interaction with legacy systems, and the need for new legal standards derived from underlying technical issues. Ultimately, these factors combine to create significant business issues related to governance, accountability, and commercial risk for organizations deploying AI.
